Costs Orders against Solicitors are rare but not unheard of, particularly where there is found to be a dereliction of duty by a Solicitor in the conduct of a client’s matter, involving matters of fraud or dishonesty.  Further, a Solicitor may be exposed to costs Orders where they have initiated or continued a court proceeding which they know or ought to know has no reasonable prospect of success. In a modern day twist the decision of Kim v AAI Ltd & Ors (M4136/8) involved a Solicitor’s failure to disclose their client’s activities on Instagram, and were the subject of an Indemnity Costs Order.
