Lawyers should keep their client regularly informed of the legal fees being incurred and compare this to the estimate provided to the client. Render interim bills on a monthly basis and monitor the total legal costs against the estimate. Bill “high velocity” files more regularly to ensure the estimate is not exceeded – consider weekly billing to ensure the firm and the client remain fully informed of the level of legal costs. Any adjustments to the estimate, together with the reasons for the changes, must be made promptly to the client, in writing (Section 315 Legal Profession Act 2007 (Qld)).
